Rent Reviews
Most rent reviews within commercial leases require the parties to agree an open market rent. To obtain the very best outcome for either a landlord or tenant client we apply both accurate market evidence, much of which we have first-hand experience of as we have done the deals, and our direct market intelligence. Rent reviews are complex and a thorough understanding of caselaw and legislation, together with an eye for detail, is essential to ensure that the rent review provisions are accurately interpreted and applied. The majority of rent reviews we handle are settled amicably and in a timely fashion but in the event that a negotiated settlement can’t be reached then we apply all of this knowledge and expertise when acting as Expert Witness at Third Party proceedings (whether Arbitration or Expert Determination) and advise the client fully on cost protection measures such as service of Calderbank offers.
Lease Renewals
A more strategic approach is required when dealing with lease renewals and early advice is essential. As with a rent review, we apply our sector knowledge and skills in assessing the new rent. However, at renewal it is also necessary to have a full understanding of the market to ensure the new lease terms reflect market norms. This is where we can use our own market analysis and intelligence within the industrial and logistics sector to fully advise both landlord and tenant clients to secure the best outcome, whether the lease is inside or outside the Landlord and Tenant Act 1954. Armed with the evidence, intelligence, technical expertise and experience, this approach usually results in time effective settlements. If this can’t be achieved and it is a 1954 Act renewal, then we liaise closely with our clients Solicitors and act as Expert Witness at PACT/Court Proceedings.
